Industrial Design

 

  Information For Industrial Designs 

  1. In Egypt claim priority according to Paris Convention within ( 6 months from the first filing date) .
  2. Egypt Is Member of (  Paris Convention) .
  3. Period of protection of a design (10 years) .
  4. Annuities ( the protection shall be extended for a further period of five years when the owner of the industrial design applies for a renewal within the last year of the protection period. The owner may, however, apply for a renewal of the registration within three months after the expiry of the protection period, failing to do so, the Department shall automatically revoke the registration) .
  5. Allowed time to submit the assignment deed from the date of signing the agreement: no time restrictions.

Industrial Designs – Filing Requirements

Patent

 

 Information For Patents Filing 

  1. In Egypt , You can claim priority according to Paris Convention within ( 12 months from the first filing date) .
  2. Egypt Is A Member of , PCT, Paris Convention.
  3. Period of protection of a patent ( 20 years) .
  4. Annuities: a progressive annual fee shall be paid on the second year until the expiration of the patent protection period.
  5. Allowed time to submit the assignment deed from the date of signing the agreement: no time restrictions.
  6. Late filing of the power of attorney and the certificate of incorporation is allowed within 4 months from filing date without penalty. However, the late filing of the priority document is allowed within 3 months from the filing date.
  7. There is a substantive examination for the design for novelty, with a six months grace period of earlier disclosure.

Patents – Filing Requirements

  1. Power of attorney legalized by the Egyptian Consulate.
  2. Certified copy of the extract from the commercial register or certificate of incorporation legalized by the Egyptian Consulate.
  3. Certified copy of priority document if claimed.
  4. Three copies of the specifications, claims, and drawings in English and Arabic languages.
  5. Deed of assignment signed by both parties, legalized by the Egyptian Consulate.

NOTES

  1. Late filing of documents: late filing of the power of attorney and the certificate of incorporation is allowed within 4 months from filing date without penalty.

  2. Extension of time for late filing of documents: not allowed.

 

PATENT ASSIGNMENT

  1. Power of attorney signed and sealed by the assignee, legalized by the Egyptian Consulate.
  2. Deed of assignment document signed by both parties, legalized by the Egyptian Consulate.
  3. Certified copy of the extract from the commercial register or certificate of incorporation legalized by the Egyptian Consulate.

PCT Filing

Egypt is a member of the International Convention and of the PCT (since 6 September 2003).

The time limit for entering the national phase of PCT in Egypt is 30 months from the priority date.

PCT Filing requirements in Egypt

  1. A Power of Attorney legalized up to an Egyptian embassy or consulate;
  2. A copy of the specification, claims, drawings, and abstract as published by WIPO;
  3. A copy of International Search Report;
  4. A copy of International Preliminary Examination Report; and
  5. A copy of the specification (including claims, drawings, and abstract) in Arabic.
  6. Published International application (required upon filing)
  7. International Search Report and International Preliminary Report on Patentability (can be late filed).
  8. The official language of the Egyptian patent application is Arabic. If the patent application is filed in any other language other than Arabic, the Arabic translation should be submitted to the Patent Office .

Note : 

  1. The legalization of the Power of Attorney up to the Egyptian Consulate in Arabic is required. It may be filed simultaneously or within 4 months from the date of national phase entry.
  2. If the applicant is not the inventor, a Deed of Assignment, legalized up to the Egyptian Consulate should be filed with the application or within 4 months from filing date.
  3. In case the applicant is a legal entity, an Extract from the commercial register or certified copy of the Certificate of incorporation, legalized up to the Egyptian Consulate should be submitted simultaneously or within 4 months after filing of the application.
  4. Examination of a PCT national phase patent application in Egypt : The Egyptian patent applications are subject to formal and substantive examination. The official fee for carrying out the substantive examination should be paid within 6 months from filing the application.

Copy Rights

  1. Validity of the copyright protection period before expiry: for the author’s life.
  2. Validity of the copyright protection period after the death of the author(s): 50 years.

Filing Requirements – Copyrights 

  1. Power of attorney legalized by the Egyptian Consulate.
  2. Photocopy of the passport or ID card of the applicant and the agent.
  3. Certificate indicating the registration of the art work in any other country and the registration data, if any.
  4. Two original copies of the art work.
