Saudi trademark law has provisions on criteria to establish a well known trademark. According to the law, the fame of the mark shall be determined by the extent of its recognition by the concerned consumers as a result of its promotion, the length of period of registration or use thereof, the number of countries of registration or the fame or the value of the mark and the extent of its impact in the promotion of goods or services which the mark is used to distinguish.

REGISTRATION WITH CUSTOMS DUTY

  1. Registration with Customs Duty is not applicable in Saudi Arabia, but however, it is possible to file a complaint against counterfeited products. Please note that the trademark should be registered in the Saudi Trademark Office in order to file a complaint.

Industrial Design

Industrial Designs Information

  1. You can claim priority according to Paris Convention within: 6 months from the first filing date.
  2. Member of: Paris Convention.
  3. Period of protection of a design: 10 years.
  4. Annuities: have to be paid for granted designs and pending applications at the beginning of each Gregorian year starting from the year following the application’s filing date.
  5. Allowed time to submit the assignment deed from the date of signing the agreement: no time restrictions.

PCT Filing

Saudi Arabia is a member of Patent Cooperation Treaty (PCT) Paris Convention Since August 03, 2013. The cost of obtaining a patent through national phase is same as a Saudi national application, however national phase PCT applications are granted relatively faster within 22-24 months.

The term for entering PCT national phase in Saudi Arabia is 30 months from the priority date. The Arabic and English translations of the required documents must be submitted on entering the Saudi PCT national phase entry.

Annuities are paid from the year following the application filing year. The annuity in following year shall include annuity from international filing date of PCT application. An applicant must pay annuity from January 01 to March 31 in the following year.

PCT Filing requirements in Saudi Arabia

  1. The Arabic and English translations of the required documents must be submitted on entering the Saudi PCT national phase entry. It is not possible to submit the translation at a later stage.
  2. For entry into the Saudi PCT national phase, an application must contain:
    – a copy of the PCT request (claims, specification, drawings and abstract in Arabic and English);
    – a copy of the specification;
    – a copy of the International Publication;
    – a copy of the International Search Report;
    – name and address of the applicant(s) and/or inventor(s);
    – priority data, if any.
  3. A certified copy of the Priority Document should be submitted within 90 days from the PCT national phase entry in Saudi Arabia.
  4. The original of a notarized Power of Attorney legalized up to the Saudi Consulate may be filed within 90 days from the date of the Saudi national phase entry.
  5. If the Saudi PCT national phase application is filed by a person other than the inventor, a legalized Assignment Deed between the applicant and the inventor must be submitted within 90 days from the national phase entry date.

  3. The name and identity of the author.
  4. An undertaking that the work is not quoted, i.e. it is the author’s own invention. Otherwise, the application will be canceled.
  5. Permission from the Ministry of Information allowing the distribution of the work.
