Trademarks – Filing Requirements

  2. Certified copy of the certificate of incorporation or an extract from the commercial register with Arabic or English translation, legalized by the Sudanese Consulate. If the applicant is a person, then a photocopy of the passport is required.
  3. Certified copy of the priority document if claimed.

NOTES

  1. Late filing of documents: allowed within 3 months from filing date without penalty.
  2. Extension of time for late filing of documents: can be applied for an additional period of 3 months without penalty.
 

REGISTRATION WITH CUSTOMS DUTY

  1. Power of attorney simply signed.
  2. Original copy of the registration certificate of the subject mark.
 

RENEWAL REQUIREMENTS

  1. Power of attorney simply signed.
  2. Photocopy of the registration certificate of the subject mark.

Industrial Design

 Information For Industrial Designs In Sudan 

  1. You can claim priority according to Paris Convention within: 6 months from the first filing date.
  2. Member of: Paris Convention, ARIPO.
  3. Period of protection of a design: 15 years.
  4. Annuities: The design is valid for five (5) years from the application date. Then it is possible to pay the maintenance fees every five (5) years twice, making the entire protection duration of a design fifteen (15) years.
  5. Allowed time to submit the assignment deed from the date of signing the agreement: no time restrictions.

Industrial Designs – Filing Requirements

  1. Power of attorney simply signed, with company seal.
  2. Representation of the design.
  3. Summary description of the design.
  4. Certified copy of the certificate of incorporation or an extract from the commercial register with Arabic or English translation, legalized by the Sudanese Consulate.
  5. Deed of assignment document if the applicant is not the inventor, legalized by the Sudanese Consulate.
  6. Certified copy of the priority document if claimed.

Information For Patents Filing In Sudan 

  1. In Sudan Can claim priority according to Paris Convention within (12 months ) from the first filing date  .
  2. Sudan Is A Member of ( PCT, Paris Convention, ARIPO ) .
  3. Period of protection of a patent ( 20 years) .
  4. Annuities ( are to be paid annually ) commencing on the first anniversary of the filing date.

  3. Deed of assignment document if the applicant is not the inventor, legalized by the Sudanese Consulate.

PCT Filing

Sudan Is A Member of Paris Convention , Patent Cooperation Treaty (PCT) , since April 16, 1984 .

To enter the PCT national phase in Sudan , it is necessary to provide a verified translation into Arabic And  English of the description, claims and text matter of drawings. The translation into English must be filed on entering the PCT national phase and the authorized Arabic translation may be submitted within 4 months after the national phase entry.

Filing The National Phase of ( PCT ) application In Sudan : 

  1. PCT filing number and date.
  2. Particulars of the application on the basis of which priority is claimed.
  3. International publication number and date.
  4. A Certified copy of the PCT application.
  5. A Copy of the relative international publication and search report, if any.
  6. A certified Copy of the Certificate of Incorporation of the applicant company is not required , For filing the national phase of a PCT application In Sudan .
